We live in Bethesda. Neighbor regularly picks up branches/sticks on her property which fall from trees between our properties and throws them back into our yard. These are trees that have been there long before we purchased our home.
Per Montgomery County’s website - In Montgomery County, and all of Maryland, when a tree or its branches fall it is considered an “Act of God”. This means the portion of the tree and the damage from it that is on your property is your responsibility to clean up and repair. In my mind, it’s neighbor’s responsibility to dispose, not toss back. Anyone else have a similar problem? I’m surprised she doesn’t blow leaves back into our yard. |

| Actually, I think OP is Bork g purposefully vague in order to get posters to side with her. She says the branches fall “from trees between the properties”. Usually the trees are in the neighbor’s side or on her side. You don’t have rogue trees in between. Then she says the trees have been there before they bought, which is irrelevant. So I’m guessing she knows the trees are on her own property and they are dumping trash in their neighbor’s yard. OP should be picking up after her own trees, and knows this - hence the weird declaration that the trees were there before they moved in. Are OP’s trees within her own property line? I certainly know where my property line is. The provision she cites is relevant only to when large branches trespass or break over the property line. The neighbor is annoyed at her messy trees. OP should pick up after her own trees |

Once we had a neighbor whose dog would poop on our yard.,, several days in a row. We had little kids that played in the yard. DH took a shovel and threw it back to their yard.
It stopped. Trim your tree or just pick up the sticks that get tossed back to you. And then be grateful that it is only a few sticks and branches. |

Doesn't matter: sticks in the neighbor's yard belong to the neighbor. Which makes sense because how could OP pick up debris there (or trim that side of the tree) without trespassing? Neighbor is in the wrong but as others have said, this is not something to fight over. If you can find a way to do it without starting a feud, you could give them some yard waste bags since they are already doing the work of picking up. |
+1 Just how much “trash” is your tree dropping that this is a problem? If it’s so much then you should take care of your tree. This tree is either on your side or their side and I have a feeling it’s yours. |
| We had neighbors like this. One who actually did blow the leaves from his property into our yard and another who in the midst of an epic storm that took out power to the whole area lugged large branches from his yard into ours. We had a newborn at the time and I couldn't believe someone would be so obnoxious. There's not much you can do OP - the neighbor has shown you what kind of person they are, so treat them accordingly. |
We have two trees that are right on the line. I have no idea whose they actually are. The property next door is a rental so we do the maintenance. One may need to come down. Idealy we would share the cost but i am guessing we will pay. |
Circling back. I’m not saying what they’re doing is right, but if it’ an issue that is happening so often that it’s annoying you, there might be something wrong with your tree. |

+1 Some people are just bad humans, OP. OTOH, we have had neighbors who cleaned our entire yard after a storm with a new born. But there are those who think that trees shouldn't exist - you are not going to be able to help their mental state. Ignore. |
