Here is what it says about accrual:
Rate gf Accrual. The earned sick and safe leave provided under
subsection .ill) must accrue at !! rate of at least 1 hour for every 30 hours
an employee works in the County, except an employer must not be
required to allow an employee to:
ill earn more than 56 hours of earned sick and safe leave in !!
calendar year; or
ill use more than 80 hours of earned sick and safe leave in !!
calendar year.

Nanny here. Actually, I prefer the final bill, as most employers won't cut into PTO to make up the sick days.

So 4 paid 8 hours days, and 3 unpaid, that's quite reasonable. And personally, I don't see why it should impact PTO or vacation. Yes, I think it's reasonable also. Our nanny works a 50 hour week - so 32 hours paid and 24 hrs unpaid is 56 hours, really only an additional half day of unpaid leave beyond what we already give as paid sick leave (5 days annually).

Seems fair and decent to me, and the small business exemption makes it manageable for an employer like me. Probably really tough for a small business owner with a half dozen employees though...


I will change my leave policy, because right now she gets 12 days, all her choice, which are to include sick days, plus the weeks we are off. I will change it to eight days "open" PTO and 4 days paid "sick leave." All leave rolls over.


If you had it bundled, then it makes sense to distinguish.

Nannies are not covered by bills like these. Just like McDonalds would find a way to fire you if you rolled over 7 days of sick leave and then tried to take 14 days off, a NF can easily replace you. The problem is you need to prove why you were fired, so unless you have a text that says "BECAUSE YOU ARE TAKING SO MANY SICK DAYS WE ARE FIRING YOU" you will not be able to prove anything.
