That sucks, OP. My first nanny was married to an American, and had had a work permit in the past, but was "in the queue" for her green card. It tool a lot longer than expected, and I almost had to let her go. In the end, it worked out ok, but I wouldn't go that route again.

Too many things can happen to draw out the immigration/work permit process.

You are over thinking this OP. She is not working those hours, so she doesn't get paid for those hours. Garnish her wages is not the correct term at all.

In writing, tell her she has 2 weeks (or however long) to get her shit together. If she does not, she needs to move out by the end of those two weeks.
