To pp, it was hours I worked. I would have let it go if it was time off or anything like that I felt I was entitled to. I only care because it was actual money I worked for and was owed. I told him it’s illegal not to pay a nanny the money they worked for. He paid me and it’s fine now.

Eww. You threatened to call the cops? You know that they couldn't have done anything, right?

OP here. I said I would call the cops after the dad started to threatening me. He started going on about how much he makes and how much I cost him missing those days. Then he started saying I was threatening them with saying I will take them to small claims court and how he knows people. I told him I know people too and I will call the cops if he threatens me.

Yes, this is right.

The police tend to deal w/criminal matters vs. civil unfortunately.

OP, so glad to hear that you were finally paid!

Glad you got your money. Never take a nanny job without a contract.

Do this via a certified letter so that you have “proof” that you did in fact make a written attempt to get your money in writing.

This always must be done prior to filing a case in a small-claims court.

Wishing you the very best!

OP I just wanted to clarify.....

Is the money they owe to you hours that you have actually, physically worked for them?
Or could it be money you feel was owed to you for paid time off, etc.??

If you do take them to a small claims court - make sure that you have written proof that you have requested your money.

Before you go through the headache of small claims court, you might call the department of labor in your jurisdiction. I don't know about DC, but in CA they will investigate reports of unpaid wages, force employers to pay, and impose fines and penalties (some of which will flow to you as the person who was not paid).

If you do go to small claims court, they generally do not allow you to use a lawyer (and it's not worth it anyway). You don't need a contract if you have texts or anything in writing acknowledging the basic terms of your arrangement and/or the hours that you worked. Keep every piece of correspondence (text, email, etc.) that you have. Also, you should immediately make a log of all of the hours you worked and all of your conversations with these people before you forget any details.

I'm sorry you have to deal with this, but I am confident you will get paid, one way or another. Good luck!

OP here. I have called, texted, and emailed on Monday, Tuesday, and Wednesday and they have ignored me. Haven’t actually told me I’m fired but they haven’t responded to any of my text messages about if they still need my help or wanted me to come in now that I’m feeling better. I finally asked for the money I’m owed and they still haven’t responded. I know they are getting my texts because it says “ read” on it.

Hi again, I'm the PP who added links to small claims court.

This (the fact their phones send you read receipts but they are not responding) just tells me that they are either not very bright or really couldn't care less. Send a letter threatening to sue, where you outline everything. If you can get a lawyer to take a look pro bono (for free) that would be good. Or you could post it in one of the more frequented forums and a lawyer or two might respond (maybe under Jobs?).

Where did you see that OP "demanded" to come in sick?

I'm an employer, not a nanny. And with RBG's passing this week, this woman stepping forward to claim her rights to her pay makes it the best thread in a long while.

I also told them that I understand if they no longer want to work with me and to let me know when to pick up the money I’m owed. The dad is home all day and can easily text me. It’s rude and disrespectful for them not to text me back. Yes I’ve sick but I’ve been very understanding with them canceling 3 times. I think they should reply to me and at least let me know what’s going on.

Sue the bastards for back pay.

It definitely looks like the employer is the woman on the other thread. Get your money, and get out. Spread the word to all the other Nannies. Use her name. Use her address.

Please send her an exact invoice. On the other thread she says she owes you $600. Do not let her cheat you. I would file/serve /whatever you do for small claims court with an exact amount. You know she is going to low-ball you and think you will not go to trouble for $50/whatever she didn't pay you. If you take her to court and you win (and you will) she will have to pay you even more.

Take charge, you are woman. Ruth Bader Ginsburg would be proud of you.

Employer is scum.
