We did it for 3 years though both parties paid through payroll. But honestly, I’m not sure how that works because we both had our own EIN and paid taxes on what we individually paid the nanny. I think if you did get flagged, as long as you have a signed contract, the other family would be the ones getting penalized. We have friends who have a share, one uses a payroll service and the other does the taxes themselves and no issues (they started their share a few months before us).

Officially, will it look like only the family paying on the books is the employer and therefore have to pay minimum wage since other family “doesn’t exist”?

You can tell the payroll company that part of the pay will be in cash o think, but it still has to be on the paystub
