I'd talk to her before firing her. tell her what you saw and ask her not to do it again regarding the phone. Second, tell her you didn't see her at the mall. See what she says. If anything like this happens again, then fire. But not yet. Not eggregious enough, if you ask me.

Meh, I think being on the phone for 20 minutes while in the same room as the kids is ok once in a while.

Not being at the mall though would concern me and I would want to know where she was taking my child.

My mb/DB text me a lot but I try to limit checking my phone. As for going places...,I send a ton of pics of what we are doing. They can always see where I'm at. Videos too.
