While what they are doing is wrong, it sounds like a misunderstanding, as you originally agreed to this arrangement (albeit mistakenly).

Do NOT let them take any money for the payroll service, and look for a new job. If they try to fire you or bad mouth you, you can threaten to file for unemployment... You will likely get it.

I don't think it is going to be a big problem if they don't give you a reference, either. You can either keep them off your CV completely, or put them in and explain that you left under bad circumstances as they tried to pull this shit on you and tried to get you to break the law.

DO NOT..... I repeat....DO NOT (!!) accept a 1099 from them!! You are their employee....Not an independent contractor at all!!!!!!
If you choose to comply w/them & opt for the 1099, trust me.....You will be paying much more to the IRS!!

So you have two options here:

.• Accept your payment in ca$h from now on to simplify the tax issue.

Or:

.• If working off-the-books really is something you do not feel 100% comfortable doing, then declare everything a bad match and find a new family that is willing to give you a W-2 and do things right.

I'm sorry that you are going through this. People feel like high end care should be available to them at daycare costs. Good for you for standing up for yourself. Do not allow them to take the $250 out of your check, and keep looking for a job. You may have to take something you're not thrilled with or take a retail position until you find the right fit. Tax paperwork gets filled out upon hiring, now you know. I also recommend a contract, it helps to get potential issues out of the way before they happen. Good luck op!

To answer your question OP, no it is not reasonable for them to expect you to pay any portion of their payroll costs. You are their employee and choosing to use a payroll service is their own choice. It sounds like it is in everyone's best interests to move on, and its good they've decided to go the daycare route rather than try to pull the same crap with someone new. Good luck finding a new position, and don't let them pressure you into staying until they get off waitlist.

To clarify again. I already did my taxes. With the W2 they did end up providing. My question was just whether I should pay half if the payroll services fee or are they being unreasonable about this. Thanks for everybody's reply. I very much appreciate it!

1099 saves them money, but costs you more. They were sort of right about that.

If they can't figure out how to do this, then they can pay a payroll service. They are only required to take out the FICA taxes, and you can do your own federal and state taxes. This is pretty simple math. You absolutely should not pay for it.
