I have worked with two families who have paid by salary. It actually is not illegal at all. I've worked for an accountant family and an attorney family. My boyfriend is an attorney and he looked over my contracts. Never once was I not paid. I was paid a weekly salary rate ( with OT) and then any additional work I did for the week was paid at my OT rate in cash. This happened with both families. I was happily paid, compensated when I didn't work, and I never once was underpaid for not compensated for hours I worked. Not all people paying salary are in it for themselves.



The IRS does not allow nannues to be paid as salaried workers. But what you are describing is not salaried. Salaried (exempt) workers don't get overtime.

Only take position if they agree to pay you hourly, and separately for individual care if someone comes home early and breaks up share. You need to be paid for each hour you work, no making up (banking) hours you missed because of their vacations, or early days! Write out a very clear contract expressing your hourly pay and no making up hours. Add any sick, or vacation days, gas reimbursement and any other details of things you want. Sent it in email telling them these are your conditions, see if they are still interested, if not well then they weren't for you! Good luck!
