Why would you hire a nanny who is pushing you to break the law for her?

Is that really the best you can do for your baby?!

You put yourself at risk and any professional license or security clearance either of you might have. Beyond stupid.

And when she goes to claim unemployment or SS and realizes she gets more if she earned more? You could then have to back pay her if she can prove you agreed to an amount and you werent paying it via payroll and fees/penalties. Just dumb.

Yes. They are trying to get away with paying less taxes. You also have been "getting away" with paying less taxes.

If she isn't insisting on a contract, write one with minimum wage and have her sign it and don't make her a copy. If there's a legal issue she will never be able to prove that you paid more than the contract stated.

If you wrote the true wage then she could use the checks to show that you underpaid her and sue you for more money.

You can also write a contract that doesn't specifically mention salary. Just say she will be paid the agreed rate and include terms like vacation etc.

Why don't you offer to pay for her health/dental/vision insurance instead of paying the cash amount? Both are nontaxable to both of you. You could also pay into an IRA for her. There are ways to compensate a nanny without doing it illegally.
