OP, honestly, I'd make it sound more like the expectation would be that she WOULD work on a snow day and then you can be the one telling her she wouldn't. The ways it's worded, she might figure she has all Federal days off except for a rare occasion, which might surprise it when it actually happens. Also clarify when you would actually be providing transportation. Especially with last years' closings where it turned out to just be raining, you don't want to be paying for a car service/taxi unless it's really necessary.

Maybe something like this?

"Inclement Weather Policy: Our jobs do not necessarily follow the Federal Government delay start and closure schedule. Should OPM announce that the Federal Government is closed, we will be in touch with you as soon as possible to inform you whether we will need you to come to work or not. Particularly if we are traveling for business, you will be expected to work if at all possible. If it is impossible to travel using public transportation, we will pay for convenient, safe travel via a taxi or car service.

Should we require you to work on a day the Federal Government is closed, you will be paid your normal rate. Should we require you to work on a day the Federal Government is closed and offer to provide safe travel to our home, and you decline to arrive, you will be charged one vacation day."


NP here. I think this language is much clearer, OP, than your draft language.

I'm the PP that posted the language suggestion, and this is what I would be afraid of exactly. Better to have her assuming that she will work and being able to then extend the day off than have her assuming that she's entitled to a day off whenever OPM calls off and then feeling disgruntled when you ask her to come in. Remember last year when we got called off for like three days and it only rained? OPM seems to have a stance since that disaster snow where everyone was stuck in traffic until midnight of calling off and just letting people plan to telework (also there has been a big telework push). They don't really mean for people not to work, they mean for people to telework.

This is also the reason I would clarify exactly when you would be paying for a taxi. Again, for those rain days - you don't mean that you would be paying for a taxi literally every time OPM calls off. You mean that if she really can't make it in on the Metro (like Metro is closed) and you really need her there, then you'll pay for a taxi.

yes. she said that because she was available to work, we should pay out the time on top of her salery. we didnt of course. to be clear this extra week was just that extra paid time off!

Wow, I can't wrap my mind around that at all. I really and truly don't understand the logic. Because she was available to work, but wasn't needed, she felt that she should get paid and then accrue that extra week of vacation for her own use and asked for it to be paid out? That is totally insane.
