This. Do you regularly work 40 hours, or are you part-time? If so then you aren't owed time and half for babysitting, though if you expected it you certainly should discuss it with your employers, because they can still give it to you.

I worked an additional 112 hours last year. May not sound like a lot more as far as pay but it is when it's supposed to be time and a half. If they go ahead and pay what they owe me then the taxes owed on this amount can just come out of what they pay me for the over time. I spoke with the payroll company and was told that they now only take care of the taxes and the W-2 and that he said he wanted to now do the payroll by himself. Also he is supposed to be giving me paycheck stubs or updating it online. He was the one who generated the pay information I posted through June 29th but he didn't do the other half of the year. I can't compare my W-2 to the paycheck stubs because he didn't finish them. When I asked him the other day about how come homework solutions hadn't updated the other half he lied to my face and said that he didn't know and they must just be behind. More like he is behind on finishing them. One thing I cannot stand is someone lying straight to my face. I have never lied to them and they shouldn't and have no reason to lie to me.

OP, you are owed overtime for every hour over 40 per week. If they want to start following the IRS laws, GREAT! Now they can start following the FLSA laws. Ask for what they OWE you.

If they were planning to report the extra then how come they didn't go ahead and take the taxes from it all right there. My theory is that they didn't take them out because they knew I would be saying hey where's my time and a half then. I really don't feel like having this you owe me money conversation with them but I don't want to get screwed again. I am hoping to bring this up in a polite way that won't result in loss of job. I am not prepared to lose this job yet and don't really make enough to have much in savings at any given time. I just started the job hunt so hopefully I can find something quickly and give notice. I'm really going to miss the kids though.

I'm sorry it makes no sense but this is what is happening. I was told that I could log in online to get my W-2 so that's what I did. There is a break down on there of what I make every three months but that's it. Homework solutions hasn't updated anything since June of last year. How the hell am I supposed to know what's going on. I asked DB about that part and he said he doesn't know why it's not updated but everything he gets from them has been updated or so he says. He wasn't reporting the additional earnings earlier in the year that was a last minute thing he says he decided to do. So now he has reported all additional income as well. The earnings that I have received look like the following on homework solutions (and are only listed through end of June so I have no idea about the other half of last year).

Part of the reason I was posting was because it seems like my employers are being very fishy with me and I would just like to know what the hell is going on.
