Yes, her job is here and shouldn't be forced to travel. The alternative is you leave the kids home and she can continue working.

It doesn't matter the way you both agreed to make the payment. That's up to you. As long as both parties are agreed. The important here is that you should make a contract with the basic details of how the position it will be, long term, short term etc.. and adding this kind of arrangement. It's up to the nanny if she wants to travel with you. When you were in the interview with your potential nannies; this is something very important that you should bring it up. Statting and asking in the interviews, that
you were looking for someone to be open and willing to travel with you, bcs you would need her to come with you like out of the country, locally or just some weeks working in your beach house in summer, for example. You would see in the interviews how many nannies refuse that and maybe if you are lucky you will find a couple who will be open to do that.

OP here,

I told my husband, we should have contract at the beginning but we are absolutely going forward, to have everything on paper and we'll both sign it.

The question of the OP doesn't have to do the way she pay her nanny. That's is their own business. But yes, agree. They should have a signed contract between both parents. Just to make sure and avoid this kind of issues. I passed two nannies positions when parents wanted to travel with them for business or vacation. I said no thank you. I like to have my own time off and I think it would be so stressful for me; traveling with the family. So I never had trouble rejecting those positions. Why should I to go? Since it's easy to find positions when parents travel or not; they have paid me my guaranteed hours. So OP... you have to pay her.

Yes, of course you have to pay her. Her job is to take care of your baby at your home.

Lots of nanny’s can’t travel due to their own family commitments. Or they can only do limited travel.

Everything has to be agreed for both parties at the hiding process. Some nannies are not open and willing to travel with the family; and just pass the position when parents requiere them to travel with them. If this is not in your contact; you can not force her to travel with you. You have to pay her the full week.

Unfortunately we don't have a signed contract. She is fairly new to our family, four months today, and we are paying cash. Nanny is responsible for her own taxes and same for us. I didn't ask about traveling because I didn't think to ask.

That's no excuse for not having a contract. Draft one up this weekend. Four months is way too long. We didn't even let our nanny start without a signed contract!

You’re playing with fire in regards to the taxes. You need to write a contract and start paying legally.

Yes you pay as normal. The only time you don’t pay is if SHE chooses to take more time off over the amount of leave you agreed to. If you take extra time over what was agreed you pay.

Do you have a contract, and does she have guaranteed hrs? All depends on that. This is why having a contract is best because then you don’t run into these issues down the road.

Yes you need to pay her. The fact she can't travel has nothing to do with it. You are asking her to be available overnight and be away from her family.
