I'm aware of the Medicare/SS withholding and have done that regardless.

You are admitting that you broke the law.

We've always hired part-time nannies through a service and the service handles payroll and taxes.

It is not legally required to withhold income taxes.

Withholding income tax is not required for household employers. It's a good idea to do it so your nanny doesn't get stuck paying their entire tax obligation when they file their return.

It works just like a traditional job. Give your nanny a W-4 and the withholding will be based on their allowances. A payroll company can help with this too.

pretty sure the law says you're not obligated to withhold income tax as long as both agree

In the past I've not withheld any income tax for our nannies, but now I'm hiring someone full time and hopefully for the long haul. What % approximately do you all generally withhold for income tax?

I'm aware of the Medicare/SS withholding and have done that regardless.
