OP, you need to get a contract in place. It will spell out things like this. A few states do require that vacation be paid out or rolled over, as a PP noted, but it varies. Many require that it be described in the contract, and most states do allow "use it or lose it" policies where you can't just be paid out--you have to take the time off (if an expiration date is set in the contract--commonly the end of the calendar year). Without something in writing, you don't have much to work off of.

I would approach your employer now about putting together a contract, since most of the calendar year is still ahead of you so there's plenty of time to take vacation if you determine that it will expire at the end of the year. And if you agree on a contract where it doesn't or where it gets paid out at that point--great. Either way, you'll know.

I've been a nanny for many years and during that time I took one week when my employers took theirs and one I took on my own. And they hired someone for the week that I took off. And in addition I was paid for my vacation time. Some times I got 4 weeks with a full week's pay. Your employer need to pay you for your vacation time, I am sure that they get pay for their vacations time. However, you have to speak up on the day of your interview to make sure you are getting all that is due you. Otherwise some of these people will screw you, everyone should get vacation pay. I worked with a company on a pastime basic and I was paid for sick leave and vacation as well. Some of these people knows the rules but if you don't speak up they won't give you.....speak up or be smart and take your due time through your sick days....those are due even to a dog.....

Maryland requires that you pay out unused vacation at the end of employment unless your contract states otherwise. I don't know about other states. Just an FYI.

Wrong. They have to give her any vacation she is entitled to. Very, very few contracts in the real world permit unlimited vacation-time pay out and that certainly isn't the default assumption in the absence of a contract.

Just being honest, I would never pay out my nanny's vacation time. We cover her vacations without paying anything, so paying essentially a $2400 bonus (for her two weeks) is not something I would do. Our contract doesn't permit rollover, but -- in practice -- we'd allow it with advance warning.

Oy! Nothing illegal about it. My contract startes that I can roll over 5 days but the rest are use it or lose it. Many large companies work the same way. Why do people who clearly don’t have law degrees spout off ‘illegal’ all the time!?! Educate yourself before forming an opinion; it will help you in all aspects of life.

OP, talk with your employer, not us as we are not in charge of your working relationship. Ask them if they would be willing to pay out unused vacation days at the end of your working year. And at that point you should definitely create a contract.

Some pay out vacation, that way they don’t have to find alt childcare or take time off. Some take their vacation when the nanny picks her week, so they wouldn’t pay out. What does your contract read?
