My sister is a nanny.The family went out of town and didn't pay her.She's a live in nanny.They also forgot to shop for grocery and she spend her money to stock up for the next four days.I told her to give her notice asap and come to maryland to stay with my family.I hate cheap and inconsiderate people.

We gave nanny wed-fri off this week. Paid her usual 43 hrs. Just easier this way.

You should definitely pay the OT. The goal is to pay her regular weekly salary, and you said the 5 OT hours are part of her regular work week.

If the OT hours were less consistent, or only on an as-needed basis, that would be different.

I pay the same "base" pay each week, which includes the OT, even when we're gone.

There is Option 3 which is pay 45 hours at base rate. OP this all depends on the contract you have with your nanny and setting expectations ahead of time.

My contract states that I am guaranteed the same base pay each week, which is also 45 hours. Nickel and diming your nanny, that likely doesn't make a ton of money, will cause bad feelings.

Nanny here.

My contract always says a specific number of hours are guaranteed, but only worked hours are eligible for overtime. Because I frequently cash out my vacation the last week of the year, I would be getting an insane amount of overtime without that proviso. It also works well when the family travels and I don't work my normal schedule. On the other hand, my guaranteed number of hours for any given week is based on the time of year and average hours per week during that time of the year. So there are times I'm only guaranteed 45, but I'm guaranteed 60 or more during the summer.

Tax wise OT is only payable for hours worked.

Yup, pay the regular full amount. The small savings is not worth the big negative message it sends if you nickel and dime.

We are leaving town for Thanksgiving for 3/5 days this week, but will pay our nanny for all 5 days. She usually works 45 hours, so we give her time and a half for the extra 5 that she works. But now I'm not sure what to pay her for this week since she's only working 18 hours.

Option 1: pay her her normal amount, including overtime.

Option 2: pay her for a 40 hour week.

The difference is about $120.

We LOVE her, and she loves our kids. But she has gotten lots of extra time off, amounting to nearly 4 weeks of vacation plus holidays, all of which we've paid her for, mostly because we've gone out of town for things (like Thanksgiving) and I don't think it's fair to not pay her when we've chosen to not need her that day. I don't want to be cheap, obviously, but I also don't want to overpay her.

What would you do? Pay her the OT or not?
