Live-in or out? If live-in, in MD, NY or another state which requires OT for live-in domestic help? If you're live-out or live-in in a state which requires it, yes, they have to pay OT. If not, then no, they don't have to pay it.

In my opinion, if they are not addressing your concerns up front, then this is a MAJOR red flag things won't get any better.

Either they agree to OT at time and a half, or you walk away.

It's the Fair Labor Standards Act (FLSA) to be specific. It applies to nannies and other domestic employees. The law says you must be paid time and half for hours worked over 40.
