Days off and days working are 2 separate things.

One is a non working day (pto/holiday/vacation/sick/etc)

One is a working day, working days count towards overtime, because you are working.

So you will get 40 hours and 10 hours holiday.

Even to be paid for ten regular hours for taking the day off is a nice bonus.

Enjoy your time off w/ten free hours of extra hourly pay.

I have to agree with your employers here. Ten hours of free money paid without working is great. If this was retail or any other job, you would receive zero.

Unless you negotiated The perk of having a weeks paid at the same rate, then your employers are correct you were only legally obligated to pay overtime on hours actually worked.

I'm assuming your contract is silent on this? In that case, your employers are correct. You have an hourly rate that is used to calculate your pay for vacation and holidays.

Why are they paying you 50 and not 40? 40 is a standard work week and you are only working 40.

I have a 50 hour week and so usually get 10 hours of overtime. My boss is telling me they don't have to pay the overtime for the coming week because I'm not actually working 50 hours. I'm only working 40 hours. So they're paying me 50 hours at my normal rate. Is this right? Where does it say this is ok?
