I always get time off in leu of OT. It's fine with me. Some weeks I work 70hrs, then other weeks 30hrs. It all evens out in the end. I'm pretty sure it's legal. My MB does it all the time with his government job. It's hour for hour.

Nanny, lets say is used to working 50 hours a week, 10 of which is overtime. Parent is saying no more overtime so OP works 40 hours at regular rate. If she works over, OP is to take it off at another time, lets say in a few weeks. So, one week if she worked 45 hours another week, she's work 35. A gov't official is not going to have 3 full time nannies. In other professions its called comp time.

I think OP is asking about the overtime pay in exchange for paid time off. It's not about the nanny's free time. It's about the nanny's forced time off because her boss isn't paying her overtime pay.

OP I don't understand what your problem is here. When you work 40 hours thats it. Then you are free until next week. Why you think you get "overtime freetime" at 1.5x the hours you would like to work is a bit ridiculous.

PP here. I'm just telling you where she is probably getting the thinking from - not that it is correct or legal! The people I know who get overtime in the federal government are all salaried, not hourly employees. So there is a definite difference. Add in the fact that you won't actually be able to use the time off, and it makes your employer's suggestion even more ridiculous.

Many jobs do comp time vs. overtime. I have a tuff time believing a gov't official in less she has a very wealthy husband has three nannies.

Federal law mandates that ALL HOURLY employees are to be paid out and banking hours is illegal. Tell her you refuse to accept this and report hetbyonlocsl wage and labor. Also, time to find a new job. This is also a valid reason for quitting and getting unemloyment.

My boss works for the government in a somewhat high profile position. She has to keep things legal. She absolutely shocked me when she told us (her nanny team of 3) that she will not pay extra OT anymore for the hours we work beyond our contracted hours. She says we have to take time off instead.

It's illegal to bank hours. It's illegal to not pay OT for hours worked over 40. I told her this and she doesn't care.

The nanny team are going crazy, because we cannot work out on how to take our time off because no one is allowed to cover the other, otherwise it would create a snowball effect.

My big question is... because OT pay is 1.5x, should we then get 1.5x time off? So if we worked an additional 2 days, we should get 3 days off in trade.
