Just pay the 45. It sounds like that's typically what she works for you, and it really isn't that much more money for you and will engender a lot of goodwill if you don't sweat the extra money. It's the holiday season -- don't be a Scrooge! It's also enlightened self interest to keep your nanny happy instead of having a debate about the extra money.

Same for transportation benefits. Dinging your nanny for those around Christmas seems so petty when, again, it's not *that* much money. If your nanny gets an extra half a tank of gas or Metro trip, good for her and good for you for paying for it.

It's common base vacation pay on whatever her standard weekly hours are. If she usually works 40 hours for you, but works 45 on occasion, then she gets vacation pay for 40 hours.

However, if she works 45 hours per week for the majority of weeks, then you should pay her 45 hours for vacation weeks. As another poster pointed out, she shouldn't be dinged because you went out of town.

That will be the expectation for the majority of nannies out there.

Likewise, a sick day should be for however many hours she works in a standard day.

OP here. Thanks for the replies. Our contract actually outlines 40 hours as the "base/guarantee," but it looks like most respondents here think we should be paying for 45 hours regardless of vacation/holiday. That's good to know. A precedent was set with an existing family, and they also pay her transportation subsidy on vacation weeks (hers or ours), so it's a matter of what is viewed as base pay.

I guarantee all the hours in her normal schedule (42.5 for us). She shouldn't lose money because we're out of town.

Her vacation "days" are also her standard "day" (8.5 hours).

No...if you always have your nanny working more than 40 hours p/week then just pay for the overtime. It's called guaranteed hours.

Why is everyone trying to nickel and dime their nannies these days? The extra 5 hours would be, what, $150-200? Can you really not afford that? This person cares for your children. Why are you going to piss her off around Christmas for a few hundred bucks. Just pay it.

Just guarantee 40 hours. The extra 5 hours are overtime. Only pay for 40 hours a week every week

If your "normal" work week is 45 hours, is that what your nanny gets for vacation, either hers or yours? We were under the impression that we wouldn't pay overtime for vacation weeks, but nanny has other expectations.
