If I found out my nanny was involved in a hit and run, I would fire her. That shows a serious lack of judgement and morality. We have our nanny drive our car so we can make sure the limits are high enough. She has her own insurance but she would be driving under our employ so we would be liable.

Insurance pays, not the person. Nanny was driving MB's car, so if Nanny was included in MB's insurance and didn't have her own insurance, only MB's insurance gets hit, and rates go up. If Nanny is on MB's insurance and has her own, her insurance takes the first hit, but both policies will go up. If she wasn't on MB's insurance, that's when it gets dicey, especially if she doesn't have a vehicle of her own, so doesn't have her own insurance.

Why would it matter at all whos car it was. This isn't like someone driving a Verizon truck. The nanny does not represent the MB. Unfortunately you will have to sue the nanny and she surely won't have any money.

MB here. Our nanny is on our insurance. Our insurance has explained that her insurance would pay first, and then our insurance would cover any additional. So, we'd both probably end up with higher rates. But, the hit-and-run would really, really bother me. I think you should pursue it.

Well I think the question that OP is asking is who will the money come from. The nanny? Or her employers? I have been hit by a car (thankfully not a hit and run) and sued successfully. However, if I was going to be suing someone who wasn't responsible for the accident, I would have given it a second thought to figure out if I really wanted to screw someone else over for something they couldn't control.

OP, I would retain a lawyer regardless to deal with the insurance. It was a pain in the ass. Asking someone who you know is a lawyer with knowledge in this area is a lot safer than asking a bunch of anon internet posters.

Nanny would definitely be in trouble. I would hope that MB/DB would evaluate whether she is allowed to drive with their kids in the car or drive their vehicle, and possibly whether to retain her or not.
If she's on their vehicle, their insurance company will take the hit, and their rates will go up. If she was driving their car without being on the insurance, they might lose their insurance.

I don't know what to tell you. I would definitely want whoever hit me to pay for my medical bills (and I would have wanted an x-ray to make sure that I didn't have any issues). However, I'm not someone who would want to sue for anything beyond what I would actually need.

How do you know that it was the nanny who hit you? If you filed a police report, do you know what the police are doing yet?

sue if you want. it is really the insurance co. but you won't get much. Nanny will probably be in big trouble with the for hit and run.

This is a wonderful example as to why having a legal forum would be super-awesome!!

I would think the nanny driving would be at fault for your injuries, but everything here would boil down to whether or not her employers put her on their car insurance or not.

A nanny driving children ran a red light on Wisconsin Ave and hit me dead on. I ended up on the hood of the car and rolled off... luckily, some fellow pedestrians helped me. The nanny quickly reversed and then drove around me... she didn't even try to pull over to see if I was injured. Another pedestrian ran after her and took a photo of the license plate. I called the police and filed a report with witnesses.

So, it turns out that the nanny was driving her employers' car. I am injured - no broken bones thankfully, but some pretty serious knee injuries/bruising/cuts/swelling.

After thinking it over, I now want to hire an attorney to sue for personal injury. This was a hit and run! I was crossing the street while the walk sign was counting down and the nanny just blew through the red light. I assume she freaked out because of the children in the car.

That being said, I think unfortunately I would end up suing the MB/DB because it was their car.

What is everyone's opinion?
