+1 Fortunately in Los Angeles (where so many trends begin) the hiring of a Spanish nanny thought to be undocumented has really fallen out of favor. I was surprised to see so many American nannies when I was out there visiting.

While I think that it is just awful how employers take advantage of the disadvantaged by paying them in peanuts, it will never be possible to arrest them for it.

Reason being is that when someone is arrested, it is assumed they will be charged and hopefully prosecuted in a court of law. In order for that to occur, sufficient evidence needs to be present since the burden of proof is on the prosecutor.

Unfortunately, people who pay in cash will have no paper trail so it will be next to impossible to prosecute them in a court of law.

Courts are already backlogged with tons of cases in other criminal matters.

It's just unrealistic to expect taxpayers to end up fronting the cost of people paying under the table.

You may not like what I have to say, but it is the truth. Theoretically, it will never happen.

Are both the neighbor being robbed and the robber both happy with the agreement? Probably not since neighbor will be upset, so you may intervene. As for the nanny, since I pointed out they are both likely happy and enjoying the relationship and nanny is satisfied and sending money home to her family then just leave them alone. If she wanted to be deported and go back to Mexico to work for $1 a day then I'm sure she could do that without much effort. But she wants to be here earning $5 an hour so MYOB.

Some crimes result in fines - like failing to pay payroll tax would get you hit with back taxes plus fines. Some crimes result in jail time, like human trafficking - in the example you gave, if the family was coercing the employee to stay, or had something to do with bringing her over and then employing her illegally.

But most cases of illegal pay towards nannies would result in a fines if caught, plus there's the personal liability of owing back wages for failure to pay over time, or failure to pay at least minimum wage.

Tons of illegal and legal first gen immigrants in this country are paid off the books.

Start with the nanny population in NYC and LA, ship them all back. I'm sure you will personally benefit.

Thing is, lots of people who make the law are the ones breaking it, so there'll never be a penalty. Except if you want a White House appointment, you might not get the job.

I agree. I wish they would arrest and send to prison all employers who hire undocumented workers.

That is exactly the issue. The poor nanny will get departed and yet nothing of consequence will happen to the cruel employers who have benefited from illegal labor for years. That, in my opinion, is what is wrong with our immigration problem.

I met a nanny who was undocumented and she was working for a kosher Jewish family for $6 an hour AND since she was not Jewish she was not allowed to eat or even touch their food or bring her own food into the house. She went ten hours a day without anything but water.

Yes, people like that should be arrested.

I spoke to a nanny yesterday who was working illegally for $8 an hour for 50 hours a week with no overtime. She was Iranian and although she did not say that she was undocumented I have to assume she is since $8 an hour here in California is under minimum wage. I felt so sorry for her!
