The problem some people run into is confusing people who are in the United States legally with being legal to work. Not the same.

I once had a foreign student on a student visa show up for a nanny interview. She was from some Western European country -- Barbie doll looking, and just assumed I would either not ask for documentation or look the other way. She kept assuring me she was here legally -- and thus could work legally. Conversation did not end well.

Green card is fine.

You may have to list her under your foreign contacts (I would) but everything is above board here, so I wouldn't worry. I've had many investigations and my foreign contacts have not held them up.

I *think* (not sure) that some clearances require you to list all non-citizens with whom you maintain regular contact. So the nanny would fall under this rule.

This is ridiculous. OP- we have had a legal resident noncitizen nanny for six years and DH and I both have had no issues with our top secret clearances. As long as you are honest and paying taxes.

Do you really think that the hundreds of thousands of people with clearances in the DC area all use US citizens for their household help?

Yes, it will take longer to get your clearance than if you hired an American with easy access records.

I am applying for my first TS clearance. I can only think of one potential slowdown-the nanny who we have had for a year is a citizen of another country. She is a legal US resident and has been here for more than a decade. We pay her taxes through Breedlove and it is all above-board. Will the fact that we have a non-US citizen taking care of our child slow down my clearance process? Any employers face this issue?
