This is very bad advice. Follow the law and pay the taxes. Don't allow a nanny, or anyone else, to talk you into breaking the law.

You don't have to withhold personal income taxes no matter how much s/he works for you.

But you should withhold FICA. You don't HAVE to, but as the employer, you are responsible for both your portion and her portion come tax time. This is for anyone who you pay more than $1900 to over the course of the year--so, clearly this will apply to you with a PT nanny.

You also have to pay state unemployment tax, which you cannot deduct or withhold from her wages.

Yes. It isn't about the number of hours per week, so much as it's about the total compensation paid out over a period of time and you will very quickly meet that threshold.
