"I hope she gets nothing." That is what you said. You also said "I did what I could to help her...If I could do more I would." You are taking this personally for whatever reason and it isn't, and you are also contradicting yourself. Figure out how you actually feel, and considering why you would want to see her suffer. By all means, speak truthfully, but there is no need to be so petty. She didnt have the option of paying into short term disability insurance through her job. She is going about this in likely the best way she knows how, and probably doesn't even realize that it will affect you (although the effect would be minuscule). Why not have a grown up conversation with her.

14:18 here, and this is exactly what I meant. Yes OPs nanny is going about this wrong, but I find OPs desire to see the screws put to her nanny, because her maternity leave sucked too, really appaling.

MB here. I understand where you are coming from because I expect to be in a similar situation soon. When I was venting to my husband he reminded me that it will cost us about 10.00 a quarter if our nanny files unemployment and I was taking the issue way too personally. He's right. If this comes to fruition for us I will answer the questions factually and leave my personal feelings out of it.

Of course I'm fighting her claim, her claim is BS!

You would have a point PP if she had discussed this with me first. Instead she blind sided me and now I have to deal with it in a legal manner. Prior to this, I was trying to figure out a way to make it work for her to stay and get the hours she needs. BTW I think I treated well, and in my mind did what I could to help "lift her up". For example, I guaranteed her a certain amount of hours per week weather she worked them or not so that she had the income she needed. I gave her a bonus at the end of the year. I did what I could to help her, but paying for her disability insurance is not an option for me. If I could do more I would have.

She is working the system a little bit, but why do you want her leave to be unpaid? She is obviously struggling (no new mom makes the decision to go from PT to FT just for kicks), and I highly doubt you offered short term disability as a benefit for her to even pay into. Mothers should be lifting up fellow mothers, not looking for ways to tear them down. In fighting among women is why we will never have true equality among, and why balancing work with motherhood will always be such a freaking struggle.

So I suppose I will find out what's going to happen then but I'm wondering if anyone else has gone through this and how it turned out.

We live in VA. Nanny chose her last day (2 weeks before her due date) and originally planned on coming back. She's always been PT. She left on good terms, gave her a baby gift and asked her if she was coming back in 2 months as we had previously agreed. She said she'd thought about it and now she doesn't want PT she wants FT. So I told her I'd check with a neighbor to see if they would be interested in doing a share with her. That was the last time we spoke. Today I get a letter from the VA Employment Commission letting me know she's trying to claim unemployment benefits from me. Huh? Does she have a shot at this? Is this how the system works, you quit or take a LOA and then file for unemployment?? I've never had paid maternity leave, always been STD benefits which I paid into each month. Shouldn't she have done the same thing or is this really how it works if you're a nanny?
