The night nanny should be paid her hourly rate. If she cannot leave then she is working. The fact that she may or may not be asleep is not the issue - if she can't leave she's working.

If she is paying legally, on-the-books then she must pay an hourly rate for sleeping hours vs. a flat rate for overnights.

Since the night nanny is being paid hourly however, it is up to the discretion of your boss whether or not the night nanny is permitted to sleep on the job or not.

My boss still wants 24hr coverage. She decided she wants to hire a second housekeeper, and "just" have them stay over night. I said my employer would be better off hiring an overnight nanny that will just stay over when the 2.5 year old is sleeping, while I'm gone. My employer has to pay on the books (legally) but was wondering what they should pay this overnight nanny for her four nights x 12 hour shifts?

This job is in NYC, for a HNW High Profile family. They pay me well, but not great .
