You can pay them less. You can get 40-50 hrs a week of child care for 350-500 per week. If you have 3 or 4 children its cheaper then daycare. A lot of families work odd hrs. Some start work at 5am or get home after midnight. Some just like the convenience of having child care whenever they need it. Yes some nannies don't like that. Getting a knock or a text at 8am on a Saturday saying I need you to work in 5 minutes doesn't appeal to every nanny but it appeals to bosses.

Yes, you will have to pay overtime if you are paying her on the books. If she cannot leave - she is working. The eight hour sleep stipulation is only is she is left completely undisturbed for that eight hour period. She cannot be considered "on call" if she is forced to sleep in your home and cannot leave.

PS If your baby sleeps through the night, why do you need a live-in five nights a week?

Thanks in most part for the responses thus far.

We are currently unable to have someone live-in on the weekend. Yes this is a technically a 24hr/4.5 day position. But my LO, 9/10 nights will sleep without a peep! If she does wake-up and the nanny has to tend to her, I will pay for that time. But under the law, if she is able to sleep 8hrs uninterrupted, I am able to to pay her only for 16hrs out of 24hr period. The DOL made this very clear.

Thank goodness for that stipulation, because we probably could not afford to offer such a good rate 24 hours a day.

Is this considered a live-in or live-out position?

Reading many posts, it appears that $20 for one child is pretty great. She will have no other housekeeping duties, only after the child.

Pp, would you be interested in the position without those changes? Specifically, paying for those 8hrs at night?

In Maryland live in nannies do get overtime of time and a half after 40 hrs. Also you have to pay her during those 8 hrs that she is able to sleep because as you stated she has to have a baby monitor on at all times. So technically she is working and still responsible for the child. She can't leave so she needs to be paid for those hrs as well.

If you offered the job as a 24 hr nanny for 4 or 5 days a week and let her live in the full week that would be ideal. Then you could hire a live out nanny to work fri, sat and sun or just sat and sun during the day maybe 7-7. That way the live in nanny won't have as much burn out. She could still work every night 7 nights a week while the child sleeps and during the day those 4 or 5 days.

Op, if you don't pay someone for 8 hrs of sleep, you cannot expect them to be on duty if baby wakes up during those 8 hrs. You want a nanny to be on duty 24 hrs? You pay her.

Right now OT is the least of your concerns. This isn't a desirable offer for the type of nanny you are looking for

Unless the nanny can leave whenever she wants after 7pm, you need to pay her. You will not find any quality nanny who you expect to be available 24 hrs a day without paying her for her time. In your OP you said she'll wake up with baby if baby wakes up. So which is it? Is she on duty or is she able to come and go as she pleases during the 8 hrs of sleep.

I think the position would be more attractive as a live in with weekends off (though still living at your residence.) I would not want to be paying for an apartment that I use 8 days of the month, regardless of annual salary.

The schedule will be from 7am on Monday - 7pm on Friday (I subtracted for 4 nights of 8hrs sleep-Legal to do so.)- this 76 hrs. She may have an hour or two some weeks to go out by herself (for doctor appointments or emergency errands), but not much more than that.

OP ,what are the hours? In parts of your post, you make it sound like it is a day job. In other parts of your post, you make it sound like it is an overnight job (sleep uninterrupted unless baby wakes up). Answers will vary depending on the hours.

5pm to 8am - nanny feeds baby dinner, eats dinner herself, plays with baby, bathes baby, puts baby to bed. nanny hangs out, cleans up, etc then goes to bed and wakes up if baby wakes up. You'll likely be able to find someone for this position as they have the rest of the following day to use the apt that they are paying forsince it is only a 5 day live in position.

10am - 1am - nanny does a regular full time day with baby, and then is only on duty until 1am At that point, parent takes over if baby wakes up. Going to be MUCH harder to find someone for that arrangement. Not many people are going to want to pay the prices for an apt in this area for it to only be used for 2 days.

Now if you're saying the nanny is 24/5 but you aren't going to pay her while she's sleeping because baby usually never wakes up, well that is not acceptable.

Does she have any time she is allowed to leave the house without your child during the week? If no, she is working more than 76/hours a week.

Do you have someone in mind already? I can't imagine many people wanting to pay full rent in this area when they sleep there 2 nights per week.

We were wondering what to pay a 5 day live-in nanny? She will work Monday-Friday, around 76 hours a week. She will live out on weekends. Do we need to pay OT if she is a live-in? She will have a small room and private bathroom next to our LO. She will have free meals when she will eat with our LO. She will be able to sleep for the most part uninterrupted for 8hrs a night- she will have baby monitor on at all times, but only need to attend to child if she wakes, what is very rare.

We were thinking of paying about $16 if we do have to pay OT. Or $20 if we do not!!!! It is just for one 18 month old. We are in Chevy Chase, MD.
