I don't think you are obligated to pay her anything beyond if she's using PTO, sick days, vacation days, etc. I'm sure she figures she won't be paid for 6 months and has factored this into whether or not she should get the surgery. That said, she may be back earlier than 6 months.

OP, we need more detail to be truly helpful. Is she your exclusive employee? Do you already offer benefits such as PTO and paid holidays? Does she have guaranteed hours?

Are you paying her on the books or not? If not, you're not legally obligated because you don't legally employ her.
