Anybody can sue for anything. Whether they will win, however, is another matter. She doesn't have a case but she can take you to court.

Don't pay a cent - she's pissed off that you took another job after all the effort she went to - Nannies get their own background checks all the time at their own expense & time and don't go round suing parents for the hassle.

No she is just trying to trick you into giving her the money. Does she even have proof that it was $90? -- SHE is the one who got your background checked. Also, this happened a few months ago and she would look very petty and pathetic going to small claims over 90 bucks.

A few mos. back I interviewed for a nanny position.

The children were foster children so I had to pass a background check from the state before I could start caring for them.
During the interview, I gave the foster mom my SSN # in case she needed to submit it to the state for clearance.
She also said she was interviewing someone after me and then someone else the next morning.

By the way, the foster mom ASKED for my SSN #...I didn't just offer it to her.

So..she called me a week later and told me that my background check came back and I was in the clear.
She asked if I could start the next day.

Unfortunately, I had already accepted another position and would be unavailable to work for her.
She said she was disappointed, but wished me luck in my new position.

Fast forward a few mos. and she just called me to let me know she paid ninety dollars for the b/g check and that since I didn't end up working for her, she is entitled to the money back that she spent.
She said she discussed it with her lawyer friend and that she can sue me in a small claims court if I do not refund her the money.

I never signed a consent form for the b/g check and I was never told that she would even be checking me. Again, she disclosed that she would be conducting more interviews so I just took a wait and see approach.

Can she really sue me?
