our nanny has off for holidays in teh contract. on the rare occassion i've asked her to work on a minor holiday (Veteran's Day), i've offered time and a half since it would be hours she would not otherwise be expected to be there for. If you don't have the holiday paid off in your contract and working it does not put you over 40 hrs in the week, then they do not need (legally or morally) to pay you OT for it.

You can't be a salaried nanny. You are an hourly employee.

Quite a few larger companies do offer 1.5 rates for holiday pay. What is less common, but still also done at times, is offering 2x (double pay) for holidays. Domestic workers on the other hand normally just get regular pay unless going into OT.

It's not even customary unless you work for a company that has negotiated this perk with the employees' union.

It's not a law. I'm never sure if salaried is just shorthand for guarenteed hours, but you should have an hourly base rate documented and get paid that or OT for any extra hours worked weekly. Getting paid for every hour you work and time and a half for hours over 40 is the law.

I'm working today on this federal holiday. I was told a few weeks ago that I do not get 1.5 or 2x pay for working on holidays. I am a salaried nanny. Is it a law or is it just customary to pay overtime for holidays?
