So even illegals can get TIN from the IRS and pay taxes. Whether they pay or not pay their taxes on their income is something which you have no responsibility for. You don't need to wothhold their income taxes if they report to you they are exempt from fed or state taxes (usually becausr they expect to earn so little they would not have any liability after deductions). But frankly, unless you are paying them only a few hundred dollars a month, theor income will end up high enough for income tax liability to kick in. Separately, whether they are legal or not, you probably still have to pay employer taxes. Their social security and Medicare. If you don't, the IRS might find out. Lastly, if you hire an illegal, wouldn't that start involving the Dept of Homeland Security (for E-Verify), Immigration, Department of Labor? There is no set rate that for illegal nannys you pay X dollars less than a legal nanny rate. Frankly, I couldn't afford nanny care and started out casting a wide net, including illegals. A lot of people I interviewed or talked over on the phone were illegals and they wanted anywhere from $9 to $16 per hour for 1 child. Usually on the $10- $12 range anecdotally in my small sample pool that I talked to. But there were plenty of nonillegals asking for a rate in that range too. So the price incentive was not convincing enough for me to go ahead and hire an illegal. I ended up with a citizen fluent in English. But not very experienced and is young and acts young and not as this and that as I would like. That was the tradeoff.
