Our candidate was denied for having insufficient ties to her country even though at 21 she has her own apartment, job, and a large family. She was born in a third country and immigrated as a young child - this apparently was a basis for discrimination. Disgusting.
She might not have been able to communicate her ties sufficiently, or there were other aspects she didn't share with you that swayed the application against her. For example, having an apartment is great, but if it's a rental and she's not keeping it, that's not exactly a tie to her country. Or she might have siblings or other family members already in the US, and THEY might be overstays themselves. If she is from one of the countries with very high overstay rates, then the burden of proof is higher. It's not just what she did, it's what other au pairs did before her making it very difficult for aspiring au pairs.
