OP does not need to wait until it is time for renewal. The agreement is void and should be immediately renegotiated. The nanny has put her job at risk. She'll will be lucky to retain her job, let alone get another one with this extraordinary tax treatment. [/quote] My post was completely impartial. I have been a nanny and a MB, and I gave my take on the situation honestly. Also I did not say the only way to mend the contract was if it was up for renewal, I was stating that if it was it would be easy to make amendments, I also said if the nanny is cooperative the change can be done at any point, but if she is not OP should prepare to have a replacement in the event that she quits. Regarding your assumption that the contract is void, that simply isn't true. Of course if OP decided to fire her nanny she can, and as I said above she is well within her rights to. But just because OP agreed to a benefit she now realizes is expensive and not as common as she thought does not equate to the contract being void. If a nanny told you she usually gets 5 sick days and you found out (who knows how) that previously she only received 3 sick days, that does not mean her contract is void. It is up to you to make a decision on what to do next, which firing is an option if you felt deceived but again that is a choice not an automatic voidance of the employment contract. The payment of all taxes is an excellent benefit, but not as rare as you may think. I, for one, have received many job offers that included the tax payment, but I have never took such a position because they frequently involved other household duties that I do not perform. In that case I rather pay my own taxes. OP's nanny may be hard pressed to find such a job, but that does not mean she still will not leave. She may have some other skills or means to net the same amount that she earns now, and may decide to attempt that instead of renegotiating. (Or she may quiy just because she is upset at the sudden change) This is why I advised the OP to have a back plan for coverage in case her nanny decides to walk. Please do not jump to conclusions on my post because nothing I said was self-serving.[/quote]
