APs can negotiate for more stipend - but are also liable for taxes on any perks (phone, car, gym membership, car insurance, housing, etc) and the lawsuits were not nation-wide, it depends how AP service is defined under state law). For example, au pairs are NOT considered employees in NY, California, DC, etc. [/quote] No. The lawsuit I am referencing *was* nationwide and was about antitrust (price fixing). You’re mixing that up with the labor law disputes. That’s a completely different thing. Part of the antitrust lawsuit settlement was that agencies must instruct au pairs that the stipend is only a floor and they can and should negotiate pay. Which smart au pairs now do and paying above stipend is becoming the norm. [/quote]
