Plenty of employers require no drugs on and off duty. My contracts always read that I will submit to any drug or alcohol testing prior to or during employment, with the stipulation that testing is in a licensed facility (no at-home tests). While it may be legal in some states, marijuana is still illegal at a federal level, and until it is legal federally, I don’t see why any nanny would have an issue with this.
You cannot control what someone does outside of work. I don’t see why any nanny would want to be controlled this way. I can just imagine the day to day working for that type of family.
I hate it when nannies misstate what people in corporate jobs face. YES employers can “control” what you do outside of work by requiring you to pass background checks. I personally don’t care if my nanny uses cannabis products but it’s just not true that employers can’t make demands like that.
I hate it when people don’t know the difference between a background check and a drug test. And no, your employer cannot control what you do. They can request you don’t do drugs and inform you that they may have drug testing. However, it depends on the state laws and circumstances.
