Do not provide a W-2. AP is a non-resident. By filing a W-2, IRS may mistakenly think she is subject to employment taxes (FICA, Medicare), which she is not. And, no, you won't get audited - she wouldn't be on Schedule H of your return. She would be listed as a childcare provider in the deduction portion by name and SSN. [/quote]
