However, if she wants to pay less for evening sitting outside of your regular job, she can certainly set a lower rate, but she shouldn't expect you to accept it. In other words, she should be employing a different babysitter in the evening at whatever rate she wants to pay.

But legally she can't. Legally, she owes 1.5x for anything over 40 hours, no matter what you want to call it. This is why my nanny, who desperately wants to earn more money, rarely babysits for us. I hire someone else, and refer her to other people.[/quote]
