Because my job is to watch over child while he sleeps.[/quote] The federal law is there to reflect the reality that there are jobs where someone is needed to be on-call, on-site for 24 hours but may be able to spend the time sleeping the majority of the time. Of course if you have a job where you will be up most nights, such as night nurse for a newborn, that would not apply to you. You wouldn't get paid for that time just because you were awake, but only if there was actual work that needed doing. This is, of course, just the legal minimum. An employer can pay you for sleeping hours if they wish, just as they can pay you more than minimum wage. I'm not familiar with the 24 hour nanny job market, so if the standard is 24 hour pay, then that may be what the market is requiring. I was just responding to the OP who was comparing night sleep time to nap time. Legally, it is different.[/quote]
