So my current family and I don’t have a contract, and to be reasonable ( dumb me I know ) if there’s a holiday and falls on my guaranteed hours they pay me for half a day only, not the whole day like they should and of course I’m off. But only big holidays, 4th of July, thanksgiving, Christmas, New Year’s Day that’s all we’ve counted so far in my almost 3 years of working with them.
On Monday I came to work, mom had off cause it was a holiday, I don’t get that holiday so I don’t count it as a major one and even tho now it’s considered a big one many people still work ( it was MLK Day ) and since mom had off they told me to come 5 hrs only but since it was under my guaranteed 20 hrs a week I still got paid for 20 hrs but they were a little confused/Upset?
Which I don’t get cause if it was a holiday I’d get paid for 5 hrs AND I’d be off. But since I came on a “holiday” I should be paid time and a half technically
What I mean is i didn’t consider Monday as a holiday otherwise I’d be off, I considered Monday as a day I worked half a day and since it was under 20 hrs they had to pay me for 20 hrs anyway
They sent me this text, context, my schedule for January when they told me on Monday they’d only need me 5 hrs, she only said she was off not that it was a holiday.
“it was my understanding we were on the same page about Monday being a holiday. Or else I would have utilized you for your 10 hours. Moving forward we can establish what holidays count towards 5 hour days so there’s no confusion. Sorry!”
Like on holidays I don’t work period but I get paid for 5 hrs. And if I work I get paid for the whole day if I only work half or I get paid more for coming on the holiday, I even got an uber cause my usual bus wasn’t running… am I wrong for making them pay for my guaranteed hours?
I’m setting up a contract, in this case, for holidays if I HAVE to come in what should the clause be?
