OP here, thank you. That is what our research indicated. We have been paying into that fund for payroll. Do you have a resource that lays out how it works? we found one, but I wanted to ask. Thank you.

Why would Nannie’s not be eligible for FMLA?
It’s a job and they pay taxes just like any other in DC

FMLA is just job protection- says that an employer can't fire an employee for being out for a medical issue. It does not require the employer to pay the employee, just to hold the job. It does not apply to employers with fewer than 50 employees
