AP wants to get part-time waitress job RSS feed

Our AP has approached us to ask if we would be OK with her taking a weekend waitressing job. She does not work for us on the weekends. She wants to save money to stay as a foreign student after her AP visa expires. Would you say it is OK for her to do this? We are concerned that she would probably need the car we provide to her for her AP job for this job and also that she may be tired come Monday (she is not the highest energy AP as-is). What would you do? We don't want to be unsupportive either.

it's against the law and could put her visa status in jeopardy. Hard no.

No. But if you say no, she'll probably either do it anyway and not tell you (and lie about where she's taking the car, so you should track it). Or she'll get resentful, start doing a worse job, and you'll end up in rematch. She wants to stay in the country somehow, no matter what, and that matters more to her than you and your kids.

Say, you know what, I'm not sure I don't have much experience in this. Let's call the LCC and see what she can offer .

That way, you are not the bad guy saying no. And if she does it anyway, let her know what the kids are her #1 responsibility and that any decrease in performance would mean she has to quit that job

Also, side note, won't the restaurant need to know her work status ie she can't bc it's a J1 visa?

I’d definitely go the LCC route with this. It is illegal and puts her visa in jeopardy. Honestly, if she wants to stay and get a different visa, by working illegally, she is putting her future visa at risk. Hard no from me.

Is it legal for her to work in the country on the books on this visa? Is it legal for her to work at another job when working through whatever agency she's working from?

Of course it's illegal, it violates the J-1 visa to work for anyone other than the host family.
