My family and I are parting ways soon. Like most nannies, I get 2 weeks of paid vacation and 5 paid sick days. By the time we will be done, I would have worked 8 months out of 12. I haven’t used my sick days. The question is, do they still owe me that? I truly believe they do but I want to get your thoughts on this. I do not want to be unfair. My last family before them definitely paid me those unused days (vacation and sick days). I wanted to make it easy on them by giving them two options: I take some time off before leaving or I work the entire remaining time and they pay me for the unused sick days and vacation. Do you think that is fair. We haven’t really talked about it since they told me I wasn’t going to be needed anymore, so I want to bring it up.

No. Sick days do not get paid out. Vacation days that have been accrued do get paid out.

What does your contract say?

My contracts always specifically state whether I can rollover sick, pto and/or vacation or have them paid out if I don’t take them or we part ways.

Since you have not worked there for an entire year yet, I wouldn’t think you were eligible for any sick or vacation days paid out.

If they did pay you out - I would say maybe 1/2 benefits you would be entitled to.

We are on our second year together. So in total 1 year and 8 months.

There is no mention of that on the contract. Lesson learned. I will make sure that my contract says so next time. I just assumed it was implied.

MB here. FWIW, I would never agree to pay out unused sick days in a contract. They are for if you are SICK or have a medical appt. Companies generally do not pay out unused sick days either.

Put it in your contract next time or just take the days off before your last day.

MB here. FWIW, I would never agree to pay out unused sick days in a contract. They are for if you are SICK or have a medical appt. Companies generally do not pay out unused sick days either.


I negotiate for one of two things: unlimited sick days at employer’s discretion (I report for work, they decide if I’m too sick to be around their kids) or a set number of sick days which can be rolled over/paid out. Either way, it ends up in the contract, then there’s no issues.

MB here. Paying out sick would never occur to me—no employer I’ve ever worked for paid out sick days. Maybe that’s just who I’ve worked for but I’ve been an office professional for years over multiple sectors and that’s been the case. Now a lot of employers, including my own, are giving employees a PTO bank that they can use for whatever vacation or sick. It’s usually paid out at a lesser rate, accrues monthly but you can take it before it accrues, and you usually can’t carry much of it over. Just another option to consider as you put together your next contract.
