Yes, it’s the law. It’s also the law to pay legally on the first 40 hours.

Yes. You must pay time and a half for any portion of time over 40 hours a week and, in some states, overtime applies after eight or nine hours in one day.

And the overtime cannot be waived by the nanny/employer. In California, for example, a nanny/employee who waived overtime pay past nine hours a day can easily come back and sue you.

Yes to the above.

I’ve known of nannies who say, “I don’t charge overtime” which is not their choice to make. It’s the law. I know of one nanny who did sue and win overtime backpay for overtime and parents got hit with a huge fine.

Some jurisdictions also pay OT for working over 8 hours a day even if she doesn't work 40 hours in a week. Why don't you call your state employment office and get information from them as opposed to asking on an anonymous chat line!
