Do nanny's accept overtime hours or weekend hours pay on they weekly paycheck with taxes taken out or do you require or agree on keeping it separate and getting paid in cash or check?

Contract says 40 hours regular and any extra is between nanny and employer, nanny wants cash/checks but employer wants to pay on paycheck. just checking to make sure if i agree to keep it as cash or check of overtime and weekends that i am not doing anything illegal.

As long as you're paying OT rates (1.5x) and paying FICA taxes, it's legal. Doesn't matter if it's on one check, two checks, or all in pennies.
If the weekend checks are not at OT rate or are not being reported to the IRS, then it's illegal no matter how you pay it. |

| You must pay through payroll, meaning taxes are taken out. I know it may benefit nanny to not do this, employer as well, but it is illegal to not report wages to IRS. Also, it is Nannies, not nanny’s. |

Yes it’s illegal but this is what we do. My first 40 are direct deposit and reported etc and then they tally up any ot and reimbursements and write a separate check on Friday. They also have always given me any raises and bonuses on the side but the DD money has been the same since I started.
I really don’t care if it’s illegal. I pay taxes on my first 40 and plenty of people that don’t even go to work and sit around all day doing nothing benefit from me doing so. America has turned into a shit country and people have to do what they have to do. |
