Our first choice for a nanny has just told us while she pays taxes and has a social security card, she does not have a work permit. Is this really possible?!?! If so, I'm curious how one could get a social security card and NOT also have a work permit. She's worked for two families over the past 15 years and both withheld taxes. We're committed to doing everything above board, so if it isn't legal to hire her we won't. I'm just confused (and frustrated). Thanks for any insights! |
I doubt she has a ssn here in LA we are full of illegals (thanks Obama and this sanctuary city) and they have tax ID numbers and pay taxes. But they're still illegal. |
Don't be confused, social security number has nothing to do with work authorization. These are two distinct things. Right now things are more restricted, but generally people (used to) get SSNs when they arrived to the US as students, as family members of students or guest workers etc. SSN does not convey authorization to work by itself, you need to be in the status that allows working. Same with taxes. You can (and should) pay taxes even on income earned with unlawful employment. I should know, I've done it for years. USCIS and IRS do not share information, and do not act as enforcers on each other's behalf. Short version: if your nanny says she's not authorized to work, she's not authorized to work. |
We hired a nanny who was an aupair. She has a SSN. She is not authorized to work.
I work in healthcare and I was willing to take the risk because I don't have security clearance kinds of issues in my professional career. She is from Brazil, has a US boyfriend, and simply didn't want to go home. We do pay all the taxes, she has been with us for almost 2 years now, and we have had zero problems. Am I violating a law - yes. Personally I feel the paying taxes part is more important than the work authorization (you may not agree) and I am comfortable with my decision. |
Her social needs to say "valid for work with DHS authorization " if that little phrase isn't on it she is working as an illegal. Tax ID was created for legal self employed small business owners but nannies use and abuse it because IRS hand it out like candies to get tax money from illegals that won't get refunded back. |
She probably has a tax id number, not a social security number. |
