Hi - I am about to start working with a nanny. Trying to spell out our work contract. Our agreement so far is 25 hours per week guaranteed at $20 per hour. She will get two weeks vacation, five days sick leave and paid federal holidays. On occasion, I may ask her to work a few extra hours per week (never more than 40 total), to which she has agreed to. How would you pay such hours? Would you pay those at the contractual rate of $20 per hour or is this considered over-time? |
Not overtime unless her hours exceed forty a week. |
Regular rate unless over 40. |
Pay at the contractual rate. Overtime is ONLY relevant for hours in excess of 40 within a given week. |
