Au Pair from another family staying? Agency fee? RSS feed

We're totally new to this, but a friend has an au pair who will be done at the end of the summer, doing two years with them. My friend mentioned she wants to stay and ask if we were interested in hiring her; this friend and I had discussed our family getting an au pair in the past.

A) is this possible
B) would we pay an agency fee? How would we handle the visa etc.

1) no- she's already extended once, so she cannot stay as an AP any longer. (2 years is the max)
2) No, since she's not eligible to be an AP.

I think your friend was asking if you'd like to hire her illegally, with her overstaying her visa or returning on a tourist visa.

I advise against this, highly.

OP here. Thank you. My friend can be a little clueless, but if this is the case, we won't do it. If it had only been a year, is that possible?

If it has been only a year, then yes. She could extend with you, as a new family. Yes, you would pay agency fees, though they are typically a bit less for extension APs.

This au pair can't stay on the au pair visa, and generally, has to go home unless she's getting married, or got a student visa (though she probably would have to go home between the program & coming back), or is getting sponsored as a G-5. Are either you or your husband here on a G-4?

So, no she can't be your au pair, which means there's no agency fee to pay.

This is true- are you a WB/Diplomatic family? That's the only way.

If she is under 26, she can go back to her home country and sign back up with an agency and come on a new au pair visa. There is no rule that you can have only one au pair visa, just that each visa is for a max of two years. Yes, you would pay the agency fee.

There needs to be a 2yr gap between your first and second tour. She would need to be 24 max by the time she leaves, and match + arrive in the USA at most at 26.
