MB won't pay me for hours worked RSS feed

I take care of twin 9 month olds. I work 50 hour weeks and have been with them since April. I get 3 paid sick days per year. Last week I asked for Thursday morning off ( in advance) for an important doctors appointment. MB told me to take the day as her day was light ( works from home). I am guaranteed my weekly 50 hour plus an OT rate for any hours worked. I stayed late Friday so they cousin go see a movie. Instead of my weekly pay plus OT for the 5 hours I worked, I was compensated for regular pay.

I brought the discrepancy up with MB but she said she just have regular pay because I missed Thursday. I explained that was supposed to be separate since that was a paid sick/personal day. Then she changed the subject. The money ( $ 110) is not a big deal versus the lack of respect and agreement. I don't know of I should just let this one go?

If you're not physically present at work for the full 40 hrs for any reason then you don't get overtime. Overtime is for time WORKED not hours accrued due to sick time, vacation, holiday pay etc.

OP of course ypu should have received your regural paycheck plus whatever you worked on Friday night (i hope she already pays you 10hours overtime. 50 hours a week its already 10 hours overtime!)

Yes technically this is the law, but I wouldn't be happy about this either OP. Having your pay docked whenever you use PTO? Nope, that would not fly for me. She would either correct it or she can find another sucker once I find a new job.

Next time clarify with MB when OT rates will apply before you take time off and have it written in your contract.

OP here and you are wrong. Out agreement is that I am paid 50 hours ( 40 + 10 OT) even if I do not work the full 50 hours. I only work 4 hours on Thursdays and had already worked 46 hours that week. Add the sick day ( 4 hours) plus the 5, and you get 55 hours. I was paid my full 50 ask gauarnteed but not paid the 5 hours of additional OT that I worked on Friday night. This is wrong and I should be paid for it.

We did. Maybe I didn't clarify correctly. I am paid regular rate at 40 hours + 10 hours of OT as directed by law. Any others hours worked ( stay late, date night, etc.) are paid in addition to my regular 50 hour week, at the OT rate.

Nope. There would be no "next time" if the cheap witch didn't pay me for the day I was suppossef to be paid for with PTO. Also, $110.00 is a lit of money.

You did not put that in the OP so either you're making things up as you go along or you're wrong about the contract and what it meant.

At most jobs, its the hours worked then subtract sick for the few hours you did not make up. Its not regular pay - sick leave then over time. You sound unreasonable.

How are you going to tell me I'm wrong about my own contract? I know what the hell is there. MB was wrong and I should be compensated for it. Point blank.

You were compensated for the hours worked and sick time. Any job you have is not going to pay overtime till after 40 hours. It is NORMAL to flex a schedule if you need time off.

By law, any kind of leave does not count towards OT. So, 4 hrs of leave will be subtracted and you will be paid OT for actual time worked above 40, which in this case comes to 51hrs. She already paid you for 50, she does owe you 1 additional OT hour.
