Obviously, being fired for being pregnant is not "for cause". Would I then be eligible for unemployment benefits?

You should see a lawyer and sue the birch. But, yes, you should be able to draw unemployment as long as you are able to work and actively seeking employment. Good luck.

Yes, you are most definitely eligible for unemployment benefits.

Your former employer is most likely one of those who demand "equal rights" in her workplace, but only for herself.

An employer can let an employee go if they are no longer able to perform the duties for which they were hired. So, if you're pregnant and fully able to take care of your charge as you were when hired, fully able to do all the other duties, etc... then you may have a case.

If you are unable to do the required tasks because you are pregnant (cannot lift the child(ren) anymore, cannot be on your feet, are unable to run after a child as necessary, are experiencing significant morning sickness or other things that are affecting your ability to do the job, etc...) then your employer may have a case for firing for cause.

If you're the nanny who is HOPING to be fired for being pregnant, and counting on receiving unemployment as a result, then I wish you would stop bothering us.

I am the nanny. I am not HOPING to be fired for being pregnant, just planning/getting information for the worst scenario. I don't expect to have any trouble keeping up as I never did with my first pregnancy with 3 times the number of children that I'm currently caring for.

I'm not actually. I'm active here, and I'm an MB, but I'm not a troll. I just dislike the OP's approach re her plan for her next job.

Yes, OP, if you are this nanny, please go away. Your plan to take a job hoping to be fired for getting pregnant is a really lousy thing to do to a family, especially since you are likely to try and get yourself fired because you'd rather have the taxpayers fraudulantly pay for you not to work. Lazy.

It depends on when you are let go. If you are let go right when you are about to give birth, you are not eligible for unemployment because you have to willing and able to work.


After you get the all clear from your doctor to go back to work you can then file for unemployment then.
