If it's true, he would have the burden to prove, as a defense, that he was experiencing a psychotic episode and did not know the difference between right and wrong at the time of the crash.
Just having a mental illness is not an automatic defense that absolves someone of criminal liability. He would have to prove he was currently experiencing symptoms, not just that in high school or in the army he did. It's pretty complicated.
My prediction
The fact that he hightailed it out of there in reverse at high speed means that he knows what he did was wrong. End of the insanity defense.
We need to learn more about his history of anxiety, episodes of psychosis, medications, etc. Your statement is too black/white.

Trump took days to attempt to disavow David Duke's endorsement during the campaign and claimed he didn't know anything about white supremacists when he had been retweeting them and his own father was in the Klan.
