Couldn't it be argued that the victim had no business "being out in public" because he was harassing and threatening subway riders and he had 40 prior arrests for his actions on the subway including multiple assaults ?
The failures of the criminal justice system and the failures of the mental health system placed too many people in jeopardy--including the victim.
No, it was not a justified killing unless one or more riders reasonably feared for his/her/their life.
If the former US Marine is convicted, the situation can be addressed by the sentence which should be minimal in my opinion.

Isn’t that the whole reason to kill someone who is attacking you? That you’re scared for your life?
I’d do it in a heartbeat with no remorse if someone was attacking me.
